LES ACTIVITÉS NUCLÉAIRES : RAYONNEMENTS IONISANTS ET RISQUES POUR LA SANTÉ ET L’ENVIRONNEMENT Administrative Enforcement Committee “Nuclear” Ordinance 2016-128 of 10 February 2016 created the ASNR Administrative Enforcement Committee (Articles L. 592-41 to L. 592-44 of the Environment Code). It was set up on 19 October 2021. The creation of this Committee has added to the range of the range of enforcement measures available to ASNR. When referred to by the ASNR Commission, it has the power to issue administrative fines to the licensees of BNIs, those responsible for Radioactive Substance Transport or licensees of Nuclear Pressure Equipment (NPE), or indeed those Responsible for Nuclear Activities (RNAs) regulated by the Public Health Code. Its independence is guaranteed by law. The Committee comprises four regular members, two State advisers appointed by the Vice-President of the Council of State and two advisers from the Court of Appeal appointed by the first President of the Cour de cassation (Court of cassation). It also comprises alternate members. The duration of the members' mandate is six years. Ethics and Professional Conduct Committee The reform of the governance of nuclear safety and radiation protection (Act 2024-450 of 21 May 2024) establishes a Ethics and Professional Conduct Committee (CED) within ASNR. Article L. 592-13-2 of the Environment Code thus provides that "The Authority for Nuclear Safety and Radiation Protection shall set up an Ethics and Professional Conduct Committee which shall be responsible, under conditions determined by the internal regulations, for matters falling within the scope of Articles 13 and 14 of Act. 2017-55 of 20 January 2017 on the general status of independent administrative authorities and independent public authorities”. ASNR's internal rules of procedure stipulate that the CED comprises a total of five or seven members divided into two sections, who are appointed by resolution of the ASNR Chairman for a renewable term of three years. For the committee's first term of office, the Chairman of ASNR chose to appoint seven members, including its chairperson. The chairperson of the CED has also been appointed as the coordinator for internal whistleblowers and for matters relating to secularism. The CED's remit is as follows: ∙Providing advice on individual situations in accordance with ethical rules: Whether requested by the administration or, in certain cases, by a member of staff, these requests for advice relate to compliance with ethical obligations (regarding dignity, impartiality or probity as well as neutrality, moderation, professional discretion and independent exercise of duties) and to situations of potential conflict of interest. ∙Issuing opinions as part of ethical oversight: On referral and in the event of serious doubt on the part of the administration as to the compatibility of the activity or duties envisaged with the duties carried out over the last three years, the CED issues an opinion statement in the following situations: ‒request for authorisation to work part-time to set up or take over a business (multiple activities); ‒plans for a member of staff to leave for the private or competitive public sector; ‒proposed appointment as Director General, Deputy Director General or to a post involving labour inspection duties, of a person who has been engaged in a gainful private activity during the last three years. ∙Conducting research and addressing general questions relating to research ethics: As part of this mission, the CED may give an opinion on general questions relating to the application of the rules of professional ethics within ASNR departments and the rules governing external expert assessment (as set out in the Charter for external expert assessment carried out at the request of ASNR, appended as Appendix 2 to ASNR's internal regulations), particularly when ASNR draws on the services of GPEs. The CED can also carry out any deliberations: ∙on ethical issues concerning ASNR, in particular: its organisational and operational rules; its activities, in particular expert assessments and research, as well as those that may give rise to remuneration for services rendered; its services; ∙on ethical issues relating to ASNR's research activities. Lastly, the Ethics and Professional Conduct Committee is responsible for drawing up an annual report on its activities, in which it describes the discussions that have taken place and may include, in anonymous form, any opinions that it deems likely to help inform all ASNR staff. This report, which is sent to the Commission and to ASNR's staff representative bodies, is made public. The CED may meet either in plenary session, comprising all the members of the Committee, or in restricted session, comprising one member from each of the two sections of which it is composed. It may hold any hearing it deems necessary. The CED held its inaugural meeting on 11 December 2025. The departments ASNR's departments are made up of an Executive Committee, two support missions, 21 departments and 11 regional divisions. The task of the departments is to carry out the missions assigned by the legislator (see point 1.4.1) within the scope of national nuclear activities; they help establish the general regulations and coordinate and lead the actions of ASNR's regional divisions. The 11 "operational" departments are responsible for: nuclear power plants; innovative reactors; pressurised equipment; waste and research facilities and the "nuclear cycle"; transport and sources; ionising radiation and health; the environment and emergency situations; safety research; safety expertise; environmental research and expertise; and health research and expertise. The four departments and two cross-functional departments are responsible for: international affairs; operations and performance; scientific management; dialogue and communication; regulatory support; and support for transformation.
